Acceptance of Terms

By accessing or using sanjuancapistranoasphaltpaving.com (the "Site") or by engaging San Juan Capistrano Asphalt Paving ("we," "us," or "our") to perform any services, you agree to be bound by these Terms and Conditions. Description of Services

San Juan Capistrano Asphalt Paving provides residential and commercial asphalt paving, sealcoating, pavement repair, parking lot maintenance, and related services in San Juan Capistrano, CA and surrounding communities. Nothing on the Site constitutes a binding offer or guarantee of service availability or pricing. All services are subject to a written agreement between the customer and San Juan Capistrano Asphalt Paving.

Estimates and Pricing

All estimates provided by San Juan Capistrano Asphalt Paving - whether by phone, email, or in person - are based on information available at the time of assessment. Estimates are not binding until a written contract is signed by both parties.

Final pricing may differ from an initial estimate if:

• Site conditions differ materially from what was described or observed at the time of the estimate.
• Additional work is identified during the project that was not included in the original scope.
• Material costs change between the estimate date and the project start date due to market conditions.
• Permits, inspections, or third-party approvals not anticipated at estimate time are required.

We will notify you of any material change in scope or price before proceeding with additional work. You have the right to approve or decline any change order.

Scheduling and Cancellation

Project dates are scheduled by mutual agreement and are subject to crew availability, weather conditions, and permit timelines. We will make reasonable efforts to honor scheduled dates but cannot guarantee start or completion dates in the event of circumstances beyond our control, including severe weather, material supply delays, or permit hold-ups.

If you need to cancel or reschedule a scheduled job:

• Cancellations made with at least 48 hours advance notice will generally not result in a cancellation fee, unless materials have already been ordered or delivered specifically for your project.
• Cancellations made with less than 48 hours notice, or after materials have been procured, may be subject to a restocking or cancellation fee as specified in your written contract.

We reserve the right to cancel or reschedule work due to unsafe working conditions, including extreme heat, rain, or other weather that would adversely affect the quality of the work.

Payment Terms

Payment terms are specified in each written contract. In general:

• A deposit may be required before work begins, particularly for larger projects or projects requiring material procurement.
• Final payment is due upon project completion unless otherwise specified in the written contract.
• Accepted payment methods will be specified at the time of contracting.

Past-due invoices may be subject to late fees as specified in the written contract. We reserve the right to pursue collection of unpaid balances through legal channels if necessary.

Customer Responsibilities

To allow us to complete work safely and correctly, you agree to:

• Provide accurate information about your property and the conditions relevant to the work.
• Clear the work area of vehicles, personal property, and obstructions prior to the scheduled start time.
• Obtain any required HOA approvals before work begins, if applicable.
• Keep people, pets, and vehicles off completed surfaces for the cure period specified by the crew.
• Notify us promptly of any concerns or issues during or immediately after the project.

Warranty Disclaimers

Any workmanship warranty provided by San Juan Capistrano Asphalt Paving will be specified in the written contract for your project. Unless expressly stated in a written contract, no warranty is implied.

Warranties do not cover:

• Damage caused by customer misuse or failure to follow post-installation care instructions.
• Damage from events beyond our control, including ground movement, flooding, acts of nature, or utility line failures beneath the surface.
• Normal wear and weathering consistent with the age of the material and the local climate.
• Defects arising from conditions that were not disclosed or were not reasonably discoverable at the time of the estimate.

The Site and all information provided on it are offered "as is" without any warranty of accuracy, completeness, or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by applicable law, San Juan Capistrano Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to our services shall not exceed the amount you paid us for the specific project giving rise to the claim.

Intellectual Property

All content on the Site - including text, images, logos, and design - is owned by or licensed to San Juan Capistrano Asphalt Paving. You may not copy, reproduce, distribute, or use any content from the Site for commercial purposes without our written permission.

Dispute Resolution

We prefer to resolve any disputes directly and informally. If you have a concern about our work or services, please contact us first and give us a reasonable opportunity to address it.

If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing formal legal action. Any legal action that proceeds after mediation shall be brought in the appropriate state or federal court located in Orange County,California.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, California.
